Terms of Service

These Terms of Service govern your access to and use of the Carte AI website, application, and related services. By using Carte AI, you agree to these Terms and to our Privacy Policy.

If you use Carte AI on behalf of a restaurant, hospitality group, or other business, you represent that you have authority to bind that organization to these Terms.

• You must provide accurate account information and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You may not share your account in a way that circumvents seat, access, or security controls.
• You must promptly notify us if you believe your account has been compromised.

Carte AI helps users create restaurant menus with AI-assisted drafting, editing, layout, preview, publishing, public hosting, PDF or image asset delivery, and QR-code sharing. We may add, remove, or modify features at any time.

You retain responsibility for the menu content, restaurant information, images, branding, instructions, and other materials you submit to the service. You represent and warrant that you have the rights necessary to use that content and to authorize us to process it for the purpose of operating Carte AI.

You grant Carte AI a non-exclusive, worldwide license to host, copy, process, format, render, store, and display your content solely as needed to provide, maintain, secure, and improve the service and to operate the publishing workflow you request.

Carte AI uses AI systems to generate and revise text, structure, and presentation. Outputs may be incomplete, inaccurate, stylistically inconsistent, or unsuitable for your business. You are responsible for reviewing all generated content before use, publication, printing, or sharing.

You should verify dish names, ingredients, allergens, dietary labels, prices, descriptions, translations, and legal compliance before relying on generated output in a live restaurant setting.

When you publish a menu, Carte AI may create an immutable published version together with related public assets such as a public menu page, PDF, image, and QR code. Those assets may remain accessible through public links or QR codes until removed, replaced, or otherwise disabled by the service.

You are responsible for deciding what content is appropriate to make public and for controlling distribution of printed materials, links, and QR codes associated with your published menus.

Some features, including menu publishing, may require payment. By initiating a purchase, you authorize the applicable billing provider to charge the displayed amount and any applicable taxes or fees.

Publish credits, one-time publishing fees, and related entitlements may be subject to specific product terms shown at checkout. Unless required by law, purchases are non-refundable once the applicable credit, entitlement, or service has been granted or consumed.

• You may not use Carte AI for unlawful, fraudulent, deceptive, defamatory, infringing, or abusive activity.
• You may not upload or publish content that violates intellectual property, privacy, publicity, or other rights of third parties.
• You may not attempt to disrupt the service, probe security, scrape data at scale, reverse engineer restricted portions of the product, or bypass technical limitations.
• You may not use the service to create or distribute malware, phishing content, spam, or content that is harmful or clearly intended to deceive end users.
• You may not submit highly sensitive personal data unless we explicitly support that use case in writing.

Carte AI and its related software, branding, design elements, and service materials are owned by us or our licensors and are protected by intellectual property laws. These Terms do not transfer ownership of the service or our underlying technology to you.

If you provide suggestions, ideas, or feedback about Carte AI, we may use them without restriction or compensation to you.

We do not guarantee that the service will be uninterrupted, error-free, or available at all times. We may suspend or limit access for maintenance, security, legal compliance, or operational reasons.

You may stop using Carte AI at any time. We may suspend or terminate access if you violate these Terms, create legal or security risk, fail to pay applicable fees, or use the service in a manner that could harm Carte AI, other users, or third parties.

Sections that by their nature should survive termination, including sections relating to payments, intellectual property, disclaimers, limitations of liability, indemnity, and dispute-related provisions, will survive.

Carte AI is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that generated content will be accurate, complete, safe, legally compliant, free from third-party claims, or suitable for publication without human review.

To the maximum extent permitted by law, Carte AI and its affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to your use of the service.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the service will not exceed the greater of the amount you paid to Carte AI for the specific paid feature giving rise to the claim during the 12 months before the event giving rise to liability, or fifty U.S. dollars (US$50).

You will defend, indemnify, and hold harmless Carte AI and its affiliates, personnel, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to your content, your published menus, your violation of these Terms, or your misuse of the service.

We may update these Terms from time to time. If we make material changes, we may revise the date above and provide additional notice where appropriate. Your continued use of Carte AI after updated Terms become effective means you agree to the revised Terms.
